Peachtree Rose Marketing is a San Antonio marketing agency built on behavior, not buzzwords — and that applies to how we treat your information too. This policy explains what we collect, why, and what you can do about it. No dark patterns, no buried clauses.
01Who This Covers
This Privacy Policy applies to peachtreerosemarketing.com and the services we provide through it — including our contact forms, the website-design calculator, our text message (SMS) program, and any communication you start with us. It describes how we handle personal information for visitors, prospects, and clients.
By using this site, you agree to the practices described here. If a specific engagement (like an active client contract) has its own data terms, those terms govern that relationship. Our Terms & Conditions cover the rules of our services and the full details of our SMS program.
If you're poking around our site, texting with us, or reaching out to us, this is the part where we tell you what happens to your info. Stick around.
02What We Collect
Information you hand us
When you fill out a form, request an Authority Audit, book a call, or email us, we collect what you choose to share — typically:
- Your name and the business you represent
- Email address and phone number
- Whatever you tell us in the message field (goals, budget range, project details)
Mobile information and SMS consent
If you opt in to text messages, we also collect and keep a record of:
- Your mobile phone number
- Proof of your consent — the date, time, and method you used to opt in (the form you checked, the keyword you texted, or your written request)
- The messages exchanged with us, and delivery status such as sent, delivered, or opted out
We keep that consent record because the law requires us to show that you asked to hear from us. Section 06 explains exactly how this data is protected and why it never leaves our hands for marketing purposes.
Information your browser mentions automatically
Like most websites, we collect a few technical breadcrumbs through cookies and analytics tools:
- IP address and rough geographic location
- Device, browser type, and operating system
- Pages viewed, time on page, and how you arrived (referring site or campaign)
Three buckets: what you type into a form, your number and consent if you opt in to texts, and what your browser quietly volunteers. That's it — no secret fourth bucket.
03How We Use It
We use your information to do the actual work and to talk to you like a human. Specifically:
- Respond to your inquiries and provide the services you asked about
- Prepare proposals, audits, and recommendations tailored to your business
- Send follow-ups, project updates, and (if you opt in) occasional marketing emails
- Send text messages you have opted in to receive — customer care, appointment and project updates, and marketing — and honor your opt-out requests
- Improve our website and understand which content is actually useful
- Meet our legal, tax, and contractual obligations, including keeping proof of SMS consent
We don't use your data to make creepy, unrelated decisions about you. If we ever want to use it for something materially new, we'll ask first.
06Mobile & SMS Privacy
If you give us your mobile number or opt in to our text messages, this section governs that information. It applies in addition to everything else in this policy, and where it is stricter, it wins.
Mobile information, including phone numbers collected for SMS registration, will not be shared with third parties or affiliates for marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with any third parties except vendors supporting message delivery for our business purposes.
We do not transfer, share, sell, or disclose SMS opt-in data or phone numbers to any external organization for marketing or any other purpose, even with user consent, except as required to provide the SMS service directly and as legally required.
The only parties who ever touch it
To send you a message at all, our messaging platform and the mobile carriers have to process your number. Those vendors act only on our instructions, are bound by written contracts that forbid using your data for their own purposes, and may not resell or re-share it. Nobody else gets it.
- Our SMS platform provider — processes and delivers messages on our behalf
- Mobile carriers — route the message to your device
- Legal compliance — disclosure only where the law, a valid subpoena, or a court order requires it
That is the complete list. There is no advertising partner, no data broker, no affiliate, and no list rental — not now, and not with your permission either, because we don't ask for that permission.
How to opt out of text messages
You may opt out of SMS communications at any time by replying STOP or UNSUBSCRIBE to any message. You'll get one final message confirming you're unsubscribed, and we won't text you again unless you opt back in. For help, reply HELP or contact us directly at group@peachtreerosemarketing.com or (210) 390-6404.
You can also ask us to remove your number by email or phone using the details above — you don't have to text to get out.

A few practical notes
Consent to receive texts is never a condition of buying anything from us. Standard text messaging is not encrypted, so please don't send sensitive information such as payment card numbers or government ID numbers by text. If your mobile number changes or is reassigned, let us know so we don't message the wrong person.
Your phone number is not a product. It goes to the company that sends the text and nowhere else. Reply STOP to end it, HELP for a human.
07How Long We Keep It
We keep personal information only as long as we need it for the purpose it was collected — to serve you, run our business, and meet legal obligations — then we delete or anonymize it. Active client records are retained for the life of the engagement plus any period required by law or contract. Inquiry data from people who never became clients is pruned periodically.
If you opt out of text messages, we remove your number from our active sending list right away. We keep a minimal suppression record — your number and the fact that you opted out — so that our system knows never to message you again, and we keep your original consent record for as long as the law requires us to be able to prove it. Neither of those is used to market to you.
08Your Rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you
- Correct anything that's inaccurate
- Delete your data (subject to legal exceptions)
- Opt out of marketing emails — every email has an unsubscribe link
- Opt out of text messages — reply STOP or UNSUBSCRIBE, or contact us directly
- Object to or restrict certain processing
To exercise any of these, contact us using the details below. We'll verify your identity (so nobody else can request your data) and respond within the timeframe the law allows. We won't penalize you for asking, and you don't need an account or a lawyer to ask.
If you're a Texas resident, you may also have rights under the Texas Data Privacy and Security Act, including the right to appeal a decision we make about your request. If we deny a request, we'll tell you why and how to appeal.
09How We Protect It
We use administrative, technical, and physical safeguards to protect your information, and we apply the strictest of them to mobile numbers and SMS consent data. Specifically:
- Access controls — internal access is limited to the people who need it to do their job. Accounts are individually assigned, permission-scoped, and protected by strong passwords and multi-factor authentication where the platform supports it. Access is removed when someone's role changes or they leave.
- Contractual restrictions — every vendor, subcontractor, and service provider that touches personal data is bound by a written agreement requiring them to protect it, use it only for the purpose we hired them for, and never resell, re-share, or repurpose it. We maintain internal access controls, contractual restrictions, and security measures to prevent unauthorized sharing of user data.
- Security measures — encrypted connections (TLS) across our site and forms, encryption of stored data where our platforms provide it, reputable and vetted vendors, bot and spam filtering on our forms, and periodic review of who has access to what.
- Data minimization — we collect only what we need, keep it only as long as we need it, and delete or anonymize it after that.
- Incident response — if a breach affects your personal information, we investigate immediately, work to contain it, and notify you and the appropriate authorities as required by law.
That said, no method of transmission over the internet is 100% secure, and we can't promise an impenetrable fortress. We can promise we take it seriously and act quickly if something goes wrong.
10Third-Party Links
Our site links out to other places — our podcast studio at podcaststudiosatx.com, social profiles, and client work. Once you leave our site, those destinations run under their own privacy policies, not ours. Give them a read before sharing anything sensitive.
11Children's Privacy
Our services are built for businesses, not kids. We don't knowingly collect personal information from anyone under 13, and you must be at least 18 to opt in to our text messages. If you believe a child has provided us information, contact us and we'll remove it promptly.
12Changes To This Policy
Marketing evolves, tools change, and laws get updated — so this policy may too. When we make meaningful changes, we'll revise the “Last updated” date at the top and, where appropriate, give you a heads-up. Continuing to use the site after changes means you accept the current version.
